Order of Protection
An Order of Protection is a court order that is designed to protect the affected or injured party by prohibiting or restricting another party from engaging in acts, attempts or threats to a family, household member or a child, or from acts of stalking. The judge can order any or all of the following: forbid any further abuse, prohibit the abuser from entering the victim's place of employment, school, etc., remove or exclude the abuser from the residence of the victim, order the abuser to pay victim's court costs and attorney's fees, award temporary legal custody or physical care of the child and establish visitation rights, order the abuser not to enter the shared home for a period of time, etc.
Any household, family, dating, or engagement relationship members can get an order of protection (a spouse, former spouse, parent, child or any other person related by blood, marriage, or common law marriage, a person with whom the victim has a child in common, etc).
At Defense NY.com, we have represented clients in Family Court with matters relating to both orders of protection and stay away orders.
